1 Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Sithumina Konara ("Developer," "we," "us," or "our"), governing your access to and use of the DailyHi Android application and any related services (collectively, the "App" or "Service").

By downloading, installing, creating an account in, or otherwise using DailyHi, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not install or use the App and should uninstall it from your device immediately.

These Terms apply to all versions of the App, including any updates, patches, or new features released in the future. Your continued use of the App after any updates to these Terms constitutes acceptance of the revised Terms.

2 Eligibility

You must be at least 13 years of age (or 16 years of age in jurisdictions where a higher minimum age applies under applicable law, such as certain countries within the European Economic Area) to use DailyHi. By using the App, you represent and warrant that you meet the applicable minimum age requirement.

If you are under the age of 18, you represent that you have obtained the consent of a parent or legal guardian to use the App and to agree to these Terms. The Developer reserves the right to terminate accounts found to belong to users who do not meet the eligibility requirements.

3 User Accounts & Google Sign-In

3.1 - Authentication via Google Sign-In

DailyHi uses Google Sign-In as its sole authentication method. To access cloud-synced features of the App, you must sign in using a valid Google account. By signing in, you authorise DailyHi to access certain information from your Google account - specifically your name, email address, and profile photo - solely for the purposes of creating and maintaining your DailyHi account. We do not receive or store your Google password.

Your use of Google Sign-In is additionally subject to Google's Terms of Service and Google's Privacy Policy.

3.2 - Account Responsibility

You are solely responsible for maintaining the security and confidentiality of your Google account credentials and for all activities that occur under your DailyHi account. You agree to:

• Keep your Google account credentials secure and not share them with any third party;
• Notify us immediately at support@sithuminakonara.com if you become aware of any unauthorised access to or use of your account;
• Ensure that your use of your Google account complies with Google's own terms and policies.

The Developer cannot be held liable for any loss or damage arising from your failure to keep your account credentials secure. You acknowledge that the Developer is not responsible for any third-party actions that result from a compromise of your Google account outside of the App.

3.3 - One Account Per User

Each user may maintain one DailyHi account. You may not create multiple accounts, use another person's account without their explicit permission, or transfer your account to another person.

3.4 - Account Deletion

You may delete your DailyHi account at any time via Profile → Settings → Delete Account within the App. Upon deletion, all your personal data stored in our systems will be permanently removed within 30 days, in accordance with our Privacy Policy.

4 Premium Subscriptions & Refunds

4.1 - Freemium Model

DailyHi operates on a freemium model. Core habit tracking features are available at no charge. Certain advanced features require a paid DailyHi Premium subscription.

4.2 - Google Play Billing

All Premium subscription purchases, renewals, upgrades, and downgrades are processed exclusively through Google Play Billing. By subscribing to DailyHi Premium, you also agree to Google Play's Terms of Service and any applicable payment terms.

The Developer does not collect, process, or store any payment card information, bank details, or other financial credentials. All such information is handled entirely and exclusively by Google LLC. The Developer receives only a subscription status confirmation token from Google to verify whether your account has an active Premium subscription.

4.3 - Subscription Terms

Premium subscriptions are offered on a recurring basis (monthly or annual). The following terms apply:

• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. The renewal charge is applied to your Google Play payment method.
• Free trial: Where a free trial is offered, its duration and conditions will be clearly stated in the Google Play listing before you subscribe. If you do not cancel before the trial ends, you will automatically be charged the subscription price.
• Price changes: We reserve the right to change subscription prices. You will be notified of any price changes in advance via the App or through Google Play, in accordance with Google's policies. Continued use of the Premium subscription after a price change takes effect constitutes your agreement to pay the new price.
• Feature availability: The specific features included in the Premium subscription may change over time. We will endeavour to communicate significant changes to you in advance.

4.4 - Cancellation

You may cancel your DailyHi Premium subscription at any time through your Google Play account settings:

• Google Play Store app → Profile icon → Payments & subscriptions → Subscriptions → DailyHi
• Or visit: play.google.com/store/account/subscriptions

Cancellation takes effect at the end of your current billing period. You will retain access to Premium features until that date, after which your account will revert to the free tier. Cancellation does not entitle you to a prorated refund of any unused portion of your current subscription period, except where required by applicable law.

4.5 - Refund Policy

Refund requests are subject to and governed entirely by Google Play's standard refund policy. The Developer does not have the ability to issue refunds directly, as all transactions are processed by Google Play Billing. To request a refund:

• Visit Google Play's refund request page; or
• Contact Google Play Support directly through your Google Play account.

Requests for refunds sent to the Developer's support email will be redirected to Google Play and cannot be actioned by us. The Developer has no control over whether Google approves or denies any refund request.

5 Acceptable Use

You agree to use DailyHi only for its intended purpose as a personal habit tracking and journaling tool, and in a manner consistent with all applicable local, national, and international laws and regulations. You agree not to:

• Use the App for unlawful purposes — including but not limited to fraud, harassment, impersonation, defamation, or any activity that violates applicable law or the rights of others;
• Reverse-engineer the App — attempt to decompile, disassemble, reverse-engineer, or otherwise attempt to derive the source code, algorithms, or structure of DailyHi, in whole or in part;
• Abuse the cloud infrastructure — deliberately send excessive requests, conduct denial-of-service attacks, attempt to gain unauthorised access to our servers or databases, or otherwise interfere with or disrupt the integrity or performance of the App or its backend services;
• Circumvent security measures — bypass, disable, or otherwise interfere with any security-related features of the App, including features that prevent or restrict use or copying of any content;
• Exploit bugs or vulnerabilities — use any discovered bugs, vulnerabilities, or errors in the App for any purpose other than reporting them to us at support@sithuminakonara.com;
• Create derivative works — copy, modify, translate, adapt, or create derivative works based on the App or any portion thereof without our prior written consent;
• Use the App commercially — resell, sublicense, or otherwise commercialise access to DailyHi or any of its features without our express written permission;
• Upload harmful content — use the journal or any other feature to store, transmit, or distribute content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.

We reserve the right to suspend or terminate your account without notice if we determine, at our sole discretion, that you have engaged in any prohibited conduct described in this section.

6 Medical & Health Disclaimer

Specifically, DailyHi is not intended to:

• Diagnose, treat, cure, or prevent any physical or mental health condition, illness, or disorder;
• Replace or substitute for professional medical, psychological, psychiatric, or therapeutic advice, diagnosis, or treatment;
• Serve as a crisis intervention or emergency response tool;
• Provide clinical monitoring of any kind, including for conditions such as depression, anxiety, obsessive-compulsive disorder, or eating disorders.

Habit tracking, journaling, gratitude practice, and mood logging features within DailyHi are provided for personal reflection and general wellness purposes only. Responses you record in the journal are private to you and are not reviewed, interpreted, or acted upon by the Developer or any mental health professional.

If you are experiencing a medical or mental health emergency, please contact emergency services immediately. If you are struggling with mental health concerns, please seek the guidance of a qualified healthcare professional. The Developer expressly disclaims all liability for any health-related decisions made in reliance on the App's features or content.

7 Intellectual Property

DailyHi, including all of its content, features, design, graphics, user interface, source code, algorithms, branding, logos, and trademarks (collectively, "the App's IP"), is the exclusive property of Sithumina Konara and is protected by applicable copyright, trademark, trade secret, and other intellectual property laws.

Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use DailyHi on your personal Android device(s) solely for your own personal, non-commercial use. This licence does not grant you any right, title, or interest in or to the App or any of its IP beyond the limited right to use described here.

User-generated content - such as journal entries, habit names, and mood logs - remains your property. By storing this content within DailyHi, you grant the Developer a limited, non-exclusive licence to store, process, and transmit your content solely as necessary to provide the App's services (e.g., cloud sync). We do not claim ownership of your personal content and will not use it for any commercial purpose.

8 Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using DailyHi, you also consent to the data practices described in the Privacy Policy.

In the event of any conflict between these Terms and the Privacy Policy regarding the handling of your personal data, the Privacy Policy shall prevail.

9 Disclaimer of Warranties

The Developer does not warrant or represent that:

• The App will be available at all times or operate without interruption, error, or defects;
• The App will be free of viruses, malware, or other harmful components;
• Any errors or defects in the App will be corrected;
• The results obtained from using the App (including habit tracking outcomes, XP calculations, or streak counts) will be accurate, complete, or reliable;
• The App will meet your specific requirements or expectations.

Some jurisdictions do not allow the exclusion of implied warranties. If you reside in such a jurisdiction, some of the above exclusions may not apply to you, and you may have additional legal rights.

10 Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Sithumina Konara, his affiliates, licensors, service providers, employees, contractors, agents, or successors be liable to you for any:

• Indirect, incidental, special, consequential, or punitive damages;
• Loss of profits, revenue, data, goodwill, or business opportunities;
• Loss of or corruption to your habit data, journal entries, streaks, XP, or any other content stored within the App;
• Damages arising from your reliance on the App as a health or wellness tool;
• Damages arising from unauthorised access to your account due to your failure to maintain account security;
• Damages arising from interruptions, bugs, errors, or unavailability of the App or its cloud services;

- whether based on warranty, contract, tort (including negligence), statutory liability, or any other legal theory, even if the Developer has been advised of the possibility of such damages.

In jurisdictions where limitation of liability for consequential or incidental damages is not permitted, the Developer's liability shall be limited to the maximum extent permitted by law. In all other cases, the Developer's total aggregate liability to you for all claims arising from or related to the App shall not exceed the greater of: (a) the total amount you have paid to the Developer in subscription fees in the twelve (12) months immediately preceding the event giving rise to the claim; or (b) USD $10.00.

11 Indemnification

You agree to defend, indemnify, and hold harmless Sithumina Konara and his agents, contractors, and successors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the App in violation of these Terms;
• Your violation of any applicable law or regulation;
• Your infringement of any third-party right, including intellectual property rights or privacy rights;
• Any content you submit, store, or transmit through the App.

12 Termination

These Terms remain in effect for as long as you use the App. The Developer reserves the right to suspend or permanently terminate your access to DailyHi at any time, with or without notice, for any reason, including but not limited to:

• Your breach of any provision of these Terms;
• Conduct the Developer reasonably believes is harmful to other users, the Developer, or third parties;
• Requests by law enforcement or government authorities;
• Discontinuation or material modification of the App.

You may terminate your use of the App at any time by uninstalling it from your device and deleting your account. Upon termination - whether by you or by the Developer — all licences granted to you under these Terms will immediately cease. Sections 6, 7, 9, 10, and 11 of these Terms shall survive termination.

Termination of your account does not automatically cancel an active Google Play subscription. You must cancel your subscription separately through Google Play to stop future billing.

13 Changes to These Terms

The Developer reserves the right to modify, update, or replace these Terms at any time, at our sole discretion. When we make changes, we will:

• Update the "Last Updated" date at the top of this page;
• Display an in-app notification when you next open DailyHi if the changes are material;
• Where required by applicable law, seek renewed consent before the changes take effect.

Your continued use of DailyHi after the updated Terms have been posted constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the App and uninstall it from your device. We encourage you to review this page periodically to stay informed of any changes.

14 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer is domiciled, without regard to its conflict of law provisions. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the use of DailyHi shall first be attempted to be resolved through good-faith negotiation between the parties.

If you are a consumer residing in the European Union, you may also have the right to refer disputes to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Nothing in these Terms limits your rights to bring a claim before the courts of your country of residence if you are a consumer entitled to do so under applicable law.
